O Tribunal de Contas do Estado do Paran\u00e1 (TCE-PR) determinou, por meio de medida cautelar, que a Prefeitura de Boa Vista da Aparecida suspenda imediatamente contrato firmado em 2018 com microempresa de consultoria cont\u00e1bil, bem como deixe de realizar quaisquer novos pagamentos \u00e0 firma.<\/p>\n

A decis\u00e3o, relatada pelo conselheiro Nestor Baptista, atendeu a pedido formulado em Representa\u00e7\u00e3o interposta pelo Minist\u00e9rio P\u00fablico de Contas (MPC-PR). Conforme o \u00f3rg\u00e3o ministerial, esse munic\u00edpio da Regi\u00e3o Oeste do Paran\u00e1 terceirizou, por meio da referida contrata\u00e7\u00e3o, atividades t\u00edpicas e permanentes de contabilidade p\u00fablica.<\/p>\n

A pr\u00e1tica afronta tanto o\u00a0Prejulgado n\u00ba 6<\/a>\u00a0do Tribunal quanto a Constitui\u00e7\u00e3o Federal. Ambos os textos determinam que tarefas desse tipo sejam exercidas exclusivamente por servidores efetivos, devidamente aprovados em concurso p\u00fablico – a n\u00e3o ser que as quest\u00f5es a serem tratadas exijam not\u00f3ria especializa\u00e7\u00e3o; que fique demonstrada a singularidade do objeto a ser contratado; ou que a demanda seja de alta complexidade.<\/p>\n

Os demais membros do Tribunal Pleno do TCE-PR homologaram, por unanimidade, a delibera\u00e7\u00e3o monocr\u00e1tica do relator na sess\u00e3o de plen\u00e1rio virtual n\u00ba 15\/2021, conclu\u00edda em 2 de setembro. Os efeitos da medida cautelar, caso esta n\u00e3o seja revogada, perduram at\u00e9 que a Corte decida sobre o m\u00e9rito do processo. Cabe recurso contra a decis\u00e3o contida no Ac\u00f3rd\u00e3o n\u00ba 2160\/21 – Tribunal Pleno.<\/p>\n
