Foto: Divulga\u00e7\u00e3o.<\/figcaption><\/figure>\n<p><span data-contrast=\"none\">Os ex-Prefeitos do Munic\u00edpio de Xambr\u00ea, Waldemar dos Santos Ribeiro Filho e Lucas Campanholi devem restituir parcialmente os valores desembolsados nos Contratos n\u00ba 85\/2013 e n\u00ba 80\/2017, referentes a contrata\u00e7\u00e3o de empresa de consultoria para presta\u00e7\u00e3o de servi\u00e7os de assessoria e consultoria jur\u00eddica no Munic\u00edpio. Ocorre que estas atividades s\u00e3o t\u00edpicas das Procuradorias no Poder Executivo do Munic\u00edpio, sendo irregular a contrata\u00e7\u00e3o feita. Quanto \u00e0 empresa contratada, a unidade t\u00e9cnica concluiu que os servi\u00e7os contratados foram prestados, de modo que sua responsabilidade deve ser afastada. Contudo, o mesmo n\u00e3o se pode afirmar dos interessados que elaboraram os pareceres favor\u00e1veis \u00e0 legalidade da contrata\u00e7\u00e3o, sendo cab\u00edvel a aplica\u00e7\u00e3o de multa administrativa aos respectivos agentes.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Instado a se manifestar, o Minist\u00e9rio P\u00fablico de Contas solicitou que fosse esclarecida a rela\u00e7\u00e3o de parentesco e\/ou societ\u00e1ria existente entre a Procuradora-Geral do Munic\u00edpio de Xambr\u00ea e a advogada titular da empresa de consultoria. Em defesa foi esclarecido que ambas s\u00e3o irm\u00e3s, sendo a advogada tamb\u00e9m s\u00f3cia da referida empresa, a qual presta servi\u00e7os ao Munic\u00edpio h\u00e1 mais de 10 anos consecutivos. Diante dos fatos apresentados, o MPC-PR observou que a Procuradora deveria ter informado sua rela\u00e7\u00e3o de parentesco e declarado seu impedimento quando da avalia\u00e7\u00e3o da legalidade do Contrato n\u00ba 80\/2017, de modo a resguardar a lisura e imparcialidade de sua atua\u00e7\u00e3o.\u00a0\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"none\">Mediante o <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2022\/09\/Parecer-400-22.pdf\">Parecer n\u00b0 400\/22<\/a>, o MPC-PR opinou pela proced\u00eancia da Tomada de Contas Extraordin\u00e1ria, considerando tamb\u00e9m cab\u00edvel a fixa\u00e7\u00e3o de responsabiliza\u00e7\u00e3o ressarcit\u00f3ria, ainda que parcial, dos valores desembolsados durante a vig\u00eancia do Contrato n\u00ba 80\/2017. Isso porque, em que pese a comprova\u00e7\u00e3o da execu\u00e7\u00e3o dos servi\u00e7os, \u00e9 clara a ofensa ao <a href=\"https:\/\/www1.tce.pr.gov.br\/multimidia\/2020\/5\/pdf\/00344741.pdf\">Prejulgado n\u00ba 06 do TCE-PR<\/a>, de modo que \u201co valor m\u00e1ximo pago \u00e0 terceirizada dever\u00e1 ser o mesmo que seria pago ao servidor efetivo\u201d.
