Em suma, alegou que a requisi\u00e7\u00e3o de Certid\u00e3o de Regularidade expedida pelo Conselho Regional de Farm\u00e1cia, apontando seu respons\u00e1vel t\u00e9cnico, n\u00e3o constaria no rol do art. 30 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei 8.666\/93<\/a> e que a licita\u00e7\u00e3o visava a aquisi\u00e7\u00e3o de produtos que n\u00e3o necessitavam de farmac\u00eautico respons\u00e1vel t\u00e9cnico. Ainda, informou que a exig\u00eancia de que a empresa contratada deveria providenciar o transporte dos materiais licitados em ve\u00edculo com autoriza\u00e7\u00e3o da <a href=\"https:\/\/www.gov.br\/anvisa\/pt-br\">Ag\u00eancia Nacional de Vigil\u00e2ncia Sanit\u00e1ria (ANVISA)<\/a> n\u00e3o possui amparo legal e viola a livre iniciativa, pois impediria que a licitante, durante a execu\u00e7\u00e3o do contrato, contratasse com a transportadora que lhe oferecesse o melhor pre\u00e7o.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<h4><b><span data-contrast=\"auto\">Instru\u00e7\u00e3o do Processo<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/h4>\n<p><span data-contrast=\"auto\">A Representa\u00e7\u00e3o foi recebida, sendo indeferido o pedido cautelar para suspens\u00e3o do certame. O Munic\u00edpio de S\u00e3o Jo\u00e3o do Iva\u00ed apresentou defesa, destacando que o procedimento licitat\u00f3rio transcorreu dentro da normalidade com a participa\u00e7\u00e3o de 49 empresas, comprovando assim a lisura do certame em rela\u00e7\u00e3o \u00e0 ampla concorr\u00eancia, e que as demais exig\u00eancias estavam em sintonia com ditames legais e em estrita observ\u00e2ncia aos princ\u00edpios da Administra\u00e7\u00e3o P\u00fablica.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Instada a se manifestar, a Coordenadoria de Gest\u00e3o Municipal (CGM) opinou que o edital restringe a responsabilidade t\u00e9cnica do farmac\u00eautico nas licita\u00e7\u00f5es que n\u00e3o tem por objeto a aquisi\u00e7\u00e3o de produtos pertencentes exclusivamente ao ramo de farm\u00e1cias, e que a exig\u00eancia quanto ao transporte dos bens objeto da licita\u00e7\u00e3o por meio de empresa autorizada pela ANVISA vai al\u00e9m dos limites estabelecidos no art. 30 da <a href=\"http:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei n\u00ba 8.666\/93<\/a>, de modo que a exig\u00eancia deveria ser feita apenas como condi\u00e7\u00e3o para assinatura do Contrato\/Ata e n\u00e3o na fase de habilita\u00e7\u00e3o\/qualifica\u00e7\u00e3o t\u00e9cnica.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Apesar de tais exig\u00eancias, a unidade t\u00e9cnica ponderou que n\u00e3o houve preju\u00edzo \u00e0 competitividade, de forma que concluiu pela proced\u00eancia da Representa\u00e7\u00e3o, apenas com o prop\u00f3sito de sugerir que seja expedida orienta\u00e7\u00e3o ao Munic\u00edpio para que insira nos editais de licita\u00e7\u00e3o somente exig\u00eancias de habilita\u00e7\u00e3o\/qualifica\u00e7\u00e3o t\u00e9cnica compat\u00edveis com o previsto em lei.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">O Minist\u00e9rio P\u00fablico de Contas (MPC-PR) divergiu pontualmente da CGM a respeito da exig\u00eancia espec\u00edfica para o transporte dos bens licitados. Mediante o <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2023\/04\/Parecer-915-22.pdf\">Parecer n\u00b0 915\/22<\/a>, o Procurador de Contas observou que a norma especifica da ANVISA sobre o transporte de insumos farmac\u00eauticos destinados a uso humanos se revela compat\u00edvel a exig\u00eancia com os preceitos licitat\u00f3rios e os requisitos de qualifica\u00e7\u00e3o t\u00e9cnica. Dessa forma, votou pela proced\u00eancia apenas deste item, com a expedi\u00e7\u00e3o de recomenda\u00e7\u00e3o ao Munic\u00edpio de S\u00e3o Jo\u00e3o do Iva\u00ed para que, em futuros certames, observe as exig\u00eancias de qualifica\u00e7\u00e3o previstas em lei, ou que se amparem em regulamentos administrativos correlatos, de sorte a evitar a restri\u00e7\u00e3o indevida \u00e0 competi\u00e7\u00e3o.
