Na decis\u00e3o, em que foi julgada procedente a Representa\u00e7\u00e3o apresentada contra o certame, tamb\u00e9m foi aplicada multa ao Prefeito Renato Tonidandel.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">O edital, destinado a concess\u00e3o de Direito Real para uso de tr\u00eas barrac\u00f5es localizados \u00e0 marginal da BR 116 no bairro Parque Industrial, foi impugnado por dois participantes inabilitados que, em seguida, apresentaram Representa\u00e7\u00e3o perante o TCE-PR pugnando pela concess\u00e3o de medida cautelar para imediata suspens\u00e3o do procedimento licitat\u00f3rio, em raz\u00e3o de frustra\u00e7\u00e3o do car\u00e1ter competitivo da licita\u00e7\u00e3o.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<h4><b>Instru\u00e7\u00e3o do Processo<\/b><\/h4>\n<p><span data-contrast=\"auto\">A Representa\u00e7\u00e3o foi recebida e, quanto ao pedido cautelar, o relator entendeu que n\u00e3o foram cumpridos os requisitos legais (artigo 53 da <a href=\"https:\/\/www1.tce.pr.gov.br\/conteudo\/lei-organica-e-regimento-interno-biblioteca-biblioteca\/107\">Lei Org\u00e2nica<\/a> e 400 do <a href=\"https:\/\/www1.tce.pr.gov.br\/conteudo\/lei-organica-e-regimento-interno-biblioteca-biblioteca\/107\">Regimento Interno TCE-PR<\/a>), uma vez que os Representantes se limitaram a pleitear a suspens\u00e3o do certame de forma gen\u00e9rica. Destacou, ainda, que a concess\u00e3o da liminar prejudicaria a adjudica\u00e7\u00e3o do objeto feita \u00e0 empresa que, de boa-f\u00e9, se comprometeu em entregar o objeto licita\u00e7\u00e3o, n\u00e3o podendo ser prejudicada pelas falhas da Administra\u00e7\u00e3o. <\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Em sede de contradit\u00f3rio, <\/span><span data-contrast=\"auto\">conforme defesa apresentada pelo Prefeito Renato Tonidandel e pelo Presidente da Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, informaram que a inabilita\u00e7\u00e3o das empresas representantes foi regular, tendo-se baseado no princ\u00edpio da legalidade e da vincula\u00e7\u00e3o ao instrumento convocat\u00f3rio.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Instada a se manifestar, a Coordenadoria de Gest\u00e3o Municipal (CGM) fundamentou que o ponto a ser verificado na an\u00e1lise processual \u00e9 a legalidade ou n\u00e3o da desclassifica\u00e7\u00e3o dos participantes na licita\u00e7\u00e3o. Observou que a inabilita\u00e7\u00e3o ocorreu em decorr\u00eancia de mero v\u00edcio formal, n\u00e3o sendo oportunizado aos requerentes<\/span><span data-contrast=\"auto\"> a regulariza\u00e7\u00e3o das declara\u00e7\u00f5es que foram apresentadas equivocadamente, o que se caracteriza como formalismo exagerado, com evidente preju\u00edzo \u00e0 competitividade do certame, visto que se tratava de um erro san\u00e1vel.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Tal fato representa afronta direta ao artigo 43, \u00a73\u00ba da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei de Licita\u00e7\u00f5es n\u00ba 8.666\/1993<\/a> e, segundo entendimento do <a href=\"https:\/\/portal.tcu.gov.br\/inicio\/\">Tribunal de Contas da Uni\u00e3o (TCU)<\/a>, na falta de algum documento que n\u00e3o restrinja a competitividade ou impacte na formula\u00e7\u00e3o de propostas, podendo este ser corrigido, n\u00e3o h\u00e1 fundamento para inabilita\u00e7\u00e3o dos licitantes, sendo a falha considerada de car\u00e1ter formal. Por este motivo, opinou pela proced\u00eancia da Representa\u00e7\u00e3o a aplica\u00e7\u00e3o de multa ao artigo 87, inciso IV, \u201cg\u201d da <a href=\"https:\/\/www1.tce.pr.gov.br\/conteudo\/lei-organica-e-regimento-interno-biblioteca-biblioteca\/107\">Lei Complementar Estadual n\u00ba 113\/2005<\/a> ao Prefeito Renato Tonidandel.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Mediante o <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2023\/06\/Parecer-885-22-mpc-pr.pdf\">Parecer n\u00b0 885\/22<\/a>, o Minist\u00e9rio P\u00fablico de Contas destacou ser inequ\u00edvoco que os membros da Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, ao inabilitar as empresas representantes em raz\u00e3o de erro e omiss\u00e3o formais, pass\u00edveis de saneamento, desconsideraram a faculdade prevista no art. 43, \u00a7 3\u00ba, da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei 8.666\/93<\/a>. Ainda, observou que a desconsidera\u00e7\u00e3o se reveste de maior gravidade, quando constatado que apenas 3 empresas acudiram ao certame, de modo que a inabilita\u00e7\u00e3o das duas empresas representantes, na pr\u00e1tica, resultou na inevitabilidade do aceite de uma \u00fanica proposta. No caso em tela, a decis\u00e3o pela preval\u00eancia do formalismo exagerado, deu-se em evidente preju\u00edzo \u00e0 competividade da Concorr\u00eancia.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Diante do exposto, o MPC-PR opinou pela proced\u00eancia da Representa\u00e7\u00e3o, a fim de que seja aplicada a multa prevista no artigo 87 da <a href=\"https:\/\/www1.tce.pr.gov.br\/conteudo\/lei-organica-e-regimento-interno-biblioteca-biblioteca\/107\">Lei Org\u00e2nica do TCE-PR<\/a> aos servidores participantes da Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, uma vez serem os subscritores do documento que declarou a inabilita\u00e7\u00e3o das referidas empresas.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<h4><b><span data-contrast=\"auto\">Julgamento e Fase Recursal<\/span><\/b><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/h4>\n<p><span data-contrast=\"auto\">Conforme voto contido no <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2023\/06\/Acordao-1000-23-tce-pr-mpc-pr.pdf\">Ac\u00f3rd\u00e3o n\u00ba 1000\/23<\/a> do Tribunal Pleno do TCE-PR, o relator Conselheiro Maur\u00edcio Requi\u00e3o de Mello e Silva frisou que o formalismo em licita\u00e7\u00f5es \u00e9 tema comum a ser debatido na doutrina e jurisprud\u00eancia p\u00e1tria, no sentido de que exig\u00eancias excessivas na execu\u00e7\u00e3o do certame maculam a legisla\u00e7\u00e3o aplic\u00e1vel por prejudicar ampla concorr\u00eancia. Nesse sentido, n\u00e3o se pode excluir licitantes do processo de contrata\u00e7\u00e3o em decorr\u00eancia de quest\u00f5es irrelevantes, tais quais por omiss\u00f5es ou por irregularidades formais.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Quanto \u00e0 defini\u00e7\u00e3o de responsabilidades, a qual foi diverg\u00eancia entre a instru\u00e7\u00e3o da unidade t\u00e9cnica e parecer ministerial, t\u00eam-se que a inabilita\u00e7\u00e3o dos Representantes foi ato de responsabilidade direta dos membros da Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, de modo que n\u00e3o h\u00e1 como eximi-los da san\u00e7\u00e3o. Contudo, o Prefeito municipal \u00e9 quem exerce o controle final de legalidade sobre o certame, sendo, desse modo, tamb\u00e9m respons\u00e1vel pelo ato que inabilitou os Representantes.<\/span><span data-contrast=\"auto\">\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Deste modo, concluiu pela proced\u00eancia da Representa\u00e7\u00e3o e aplica\u00e7\u00e3o de multa aos Srs. <\/span><span data-contrast=\"auto\">Renato Tonidandel, Prefeito Municipal, Valdoir Rodrigues dos Santos, Guilherme Cavalheiro Nunes e Luiz Rodrigo Bocca, servidores p\u00fablicos membros da Comiss\u00e3o Permanente de Licita\u00e7\u00e3o, por terem infringido os artigos 29 e 43, \u00a7 3\u00ba, da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei n\u00ba 8.666\/93<\/a>.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559731&quot;:708,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Ap\u00f3s publica\u00e7\u00e3o do Ac\u00f3rd\u00e3o, de maneira tempestiva, os interessados apresentaram Recurso de Revista, alegando que as exig\u00eancias ocorreram para garantir a melhor qualifica\u00e7\u00e3o t\u00e9cnica e econ\u00f4mica, de modo que as decis\u00f5es tomadas foram em conformidade \u00e0s normas e condi\u00e7\u00f5es presentes no instrumento convocat\u00f3rio, n\u00e3o havendo dano ao procedimento licitat\u00f3rio. Ao final, requerem o recebimento e processamento do Recurso de Revista para que, no m\u00e9rito, seja dado provimento a fim de reformar a decis\u00e3o contida no <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2023\/06\/Acordao-1000-23-tce-pr-mpc-pr.pdf3\">Ac\u00f3rd\u00e3o n\u00ba 1000\/23<\/a>, julgando-o improcedente, haja vista atendimento aos ditames da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/l8666cons.htm\">Lei n\u00ba 8.666\/93<\/a> e dos princ\u00edpios basilares do direito administrativo e das normas contidas nos artigos 20 e 22 da <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/decreto-lei\/del4657compilado.htm\">Lei de Introdu\u00e7\u00e3o \u00e0s Normas do Direito Brasileiro<\/a>.<\/span><span
