Esse foi o entendimento dos membros do Tribunal Pleno ao julgar procedente o processo de Representa\u00e7\u00e3o da Lei n\u00ba 8.666\/1993 formulado pela empresa MAX CESTAS.COM LTDA em face do <a href=\"https:\/\/lupionopolis.pr.gov.br\/\">Munic\u00edpio de Lupion\u00f3polis<\/a>, quando da realiza\u00e7\u00e3o do Preg\u00e3o Presencial n\u00ba 16\/2023 para aquisi\u00e7\u00e3o de g\u00eaneros aliment\u00edcios e materiais de limpeza.\u00a0<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">De acordo com o representante, o edital de licita\u00e7\u00e3o restringiu a participa\u00e7\u00e3o do certame para empresas sediadas somente nos Munic\u00edpios de Lupion\u00f3polis, Cafeara, Santo In\u00e1cio, Centen\u00e1rio do Sul e Jaguapit\u00e3, sob justificativa de promover o crescimento econ\u00f4mico regional. Sustenta que tal restri\u00e7\u00e3o geogr\u00e1fica a prejudica os princ\u00edpios da proposta mais vantajosa e da isonomia.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Na decis\u00e3o, o Relator Conselheiro Fabio de Souza Camargo acompanhou o entendimento da unidade t\u00e9cnica e do Minist\u00e9rio P\u00fablico de Contas do Paran\u00e1 (MPC-PR), a fim de determinar a expedi\u00e7\u00e3o de recomenda\u00e7\u00e3o \u00e0 municipalidade, para que nos pr\u00f3ximos procedimentos licitat\u00f3rios que restrinjam a participa\u00e7\u00e3o de microempresas e empresas de pequeno porte situadas local ou regionalmente, observe as diretrizes estabelecidas no Prejulgado n\u00b0 27.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><b><span data-contrast=\"auto\">Entenda o caso<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Em que pese seja legal o tratamento diferenciado para Microempresas (ME), Empresas de Pequeno Porte (EPP) e Microempreendedores Individuais (MEI), assim amparado pela <a href=\"https:\/\/www.planalto.gov.br\/ccivil_03\/leis\/lcp\/lcp123.htm\">Lei Complementar n\u00ba 123\/2006<\/a>, fato \u00e9 que a defini\u00e7\u00e3o de uma restri\u00e7\u00e3o geogr\u00e1fica pode ocasionar preju\u00edzo ao car\u00e1ter competitivo do procedimento licitat\u00f3rio. No \u00e2mbito do TCE-PR existe entendimento fixado por meio do Prejulgado n\u00ba 27, o qual define que a restri\u00e7\u00e3o geogr\u00e1fica somente ser\u00e1 admitida quando devidamente justificada, n\u00e3o podendo ser apresentada de maneira gen\u00e9rica.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Isto posto, o Relator recebeu os autos conforme Despacho n\u00ba 1277\/2023, por\u00e9m, n\u00e3o acolheu o pedido cautelar proposto pelo representante, tendo em vista que eventual interrup\u00e7\u00e3o ou suspens\u00e3o do Preg\u00e3o poderia ser prejudicial \u00e0 popula\u00e7\u00e3o, considerando que o objeto da licita\u00e7\u00e3o trata de g\u00eaneros aliment\u00edcios e material de limpeza para Secretarias da Administra\u00e7\u00e3o Municipal.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Aberto o prazo para contradit\u00f3rio e ampla defesa, o Munic\u00edpio de Lupion\u00f3polis manifestou-se no sentido de que a restri\u00e7\u00e3o geogr\u00e1fica imposta \u00e9 legal, pois se trata de ato discricion\u00e1rio da administra\u00e7\u00e3o p\u00fablica, o qual visava promover o aumento de empregos, o desenvolvimento municipal e melhores condi\u00e7\u00f5es de vida aos seus mun\u00edcipes. No relat\u00f3rio, a CGM destacou a consolida\u00e7\u00e3o de posicionamento do TCE-PR por meio do Prejulgado n\u00ba 27, o qual disp\u00f5e sobre a possibilidade de se restringir a participa\u00e7\u00e3o, em procedimentos licitat\u00f3rios, a Empresas de Pequeno Porte (EPP) ou Microempresas (ME) estabelecidas em certo local ou regi\u00e3o, conforme disposi\u00e7\u00e3o do <a href=\"https:\/\/www.jusbrasil.com.br\/topicos\/10656526\/artigo-48-lc-n-123-de-14-de-dezembro-de-2006\">artigo 48, \u00a73\u00ba, da Lei Complementar n\u00ba 123\/06<\/a>. <\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Nesse sentido, destacou que o <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2023\/11\/Prejulgado-27-TCE-PR.pdf\">Prejulgado n\u00ba 27<\/a> estabelece que nos casos de licita\u00e7\u00f5es exclusivas para pequenas e microempresas, se faz necess\u00e1ria a apresenta\u00e7\u00e3o de justificativas espec\u00edficas (n\u00e3o gen\u00e9ricas).
