Na decis\u00e3o, acolhendo a manifesta\u00e7\u00e3o do Minist\u00e9rio P\u00fablico de Contas do Paran\u00e1 (MPC-PR) determinou-se que o Munic\u00edpio se abstenha de formalizar inexigibilidades para cada um dos contratos celebrados em processos de credenciamento. Conforme manifesta\u00e7\u00e3o, o Prefeito Leandro Cesar de Oliveira informou que os procedimentos de credenciamento est\u00e3o amparados pela Lei de Licita\u00e7\u00f5es n\u00ba 14.133\/2021, Lei Estadual n\u00ba 15.608\/2007 e pelo Decreto Estadual n\u00ba 4.507\/2009. No relat\u00f3rio, a unidade t\u00e9cnica considerou que o Munic\u00edpio de Araruna limitou sua defesa copiando os itens da peti\u00e7\u00e3o inicial e para cada um deles copiou e colou os trechos das leis, sem contextualiz\u00e1-los ou fundament\u00e1-los, sem escrever ao menos uma palavra a mais para tentar explanar seus pontos de vista. Nas pe\u00e7as seguintes somente apresentou c\u00f3pias das inexigibilidades questionadas, que de nada adiantaram para esclarecer a problem\u00e1tica do processo.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Em s\u00edntese, a CGM alegou que o Munic\u00edpio n\u00e3o foi capaz de desconstituir os questionamentos feitos pela unidade t\u00e9cnica e pelo Minist\u00e9rio P\u00fablico de Contas do Paran\u00e1 (MPC-PR). Por este motivo, ao entender que a situa\u00e7\u00e3o se mant\u00e9m irregular, manteve seu opinativo pela ilegalidade e irregularidade dos procedimentos licitat\u00f3rios em quest\u00e3o e, consequentemente, pela proced\u00eancia da Representa\u00e7\u00e3o com aplica\u00e7\u00e3o da multa prevista no artigo 87, IV, \u201cg\u201d da Lei Complementar n\u00ba 113\/2005 ao gestor municipal.<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">O MPC-PR, por sua vez, conforme <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2024\/09\/araruna-PAR-36_24-4PC.pdf\">Parecer n\u00ba 36\/24<\/a>, ap\u00f3s an\u00e1lise das manifesta\u00e7\u00f5es do processo, entendeu que houve a perda parcial do objeto da Representa\u00e7\u00e3o, referente ao apontamento da irregular utiliza\u00e7\u00e3o do credenciamento para contrata\u00e7\u00e3o de servi\u00e7os m\u00e9dicos.\u00a0<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">No entanto, entendeu ser necess\u00e1ria a emiss\u00e3o de determina\u00e7\u00e3o ao Munic\u00edpio, para que: <\/span><span data-contrast=\"auto\">(I) aprimore os procedimentos internos no setor de licita\u00e7\u00f5es, abstendo-se a Administra\u00e7\u00e3o municipal de formalizar inexigibilidades para cada um dos contratos celebrados em decorr\u00eancia da deflagra\u00e7\u00e3o do respectivo processo de credenciamento; e (II) <\/span><span data-contrast=\"auto\">passe a observar as diretrizes condicionantes que existem nos Ac\u00f3rd\u00e3os n\u00ba 3771\/23-STP e n\u00ba 3733\/20-STP, caso o Munic\u00edpio opte pela terceiriza\u00e7\u00e3o dos servi\u00e7os de sa\u00fade, referente aqueles prestados em Unidades de Pronto Atendimento (UPAs) e junto ao Servi\u00e7o de Atendimento M\u00f3vel (SAMU).<\/span><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<h4><b><span data-contrast=\"auto\">Decis\u00e3o<\/span><\/b><span data-ccp-props=\"{&quot;134233117&quot;:false,&quot;134233118&quot;:false,&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559685&quot;:0,&quot;335559737&quot;:0,&quot;335559738&quot;:0,&quot;335559739&quot;:160,&quot;335559740&quot;:360}\">\u00a0<\/span><\/h4>\n<p><span data-contrast=\"auto\">Conforme decis\u00e3o contida no <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2024\/09\/araruna-ACO-2314_24-STP.pdf\">Ac\u00f3rd\u00e3o n\u00ba 2314\/24<\/a> do Tribunal Pleno do TCE-PR, os membros votaram, em maioria absoluta, pela parcial proced\u00eancia da Representa\u00e7\u00e3o. Na fundamenta\u00e7\u00e3o, o Relator explicou que, conforme os citados Ac\u00f3rd\u00e3os n\u00ba 3771\/23-STP e n\u00ba 3733\/20-STP, \u00e9 entendimento do TCE-PR a possibilidade de celebra\u00e7\u00e3o de contrato de terceiriza\u00e7\u00e3o de servi\u00e7o de sa\u00fade junto ao SAMU e \u00e0s UPAs, desde que comprovada a impossibilidade de realiza\u00e7\u00e3o de concurso e a aus\u00eancia do cargo no quadro pr\u00f3prio de servidores.
