Foto: divulga\u00e7\u00e3o.<\/figcaption><\/figure>\n<p><span data-contrast=\"auto\">O <a href=\"https:\/\/www.jaboti.pr.gov.br\/\">Munic\u00edpio de Jaboti<\/a>, por meio de seu representante legal, protocolou junto ao Tribunal de Contas do Estado do Paran\u00e1 (TCE-PR) um processo de consulta a respeito da possibilidade da contrata\u00e7\u00e3o de escrit\u00f3rio de advocacia para patrocinar demandas espec\u00edficas relativas ao Tribunal de Contas, Tribunais em Segundo Grau e Tribunais Superiores, visando obter maior economicidade na presta\u00e7\u00e3o de servi\u00e7os jur\u00eddicos.<\/span><span data-ccp-props=\"{&quot;201341983&quot;:0,&quot;335551550&quot;:6,&quot;335551620&quot;:6,&quot;335559740&quot;:360}\">\u00a0<\/span><\/p>\n<p><span data-contrast=\"auto\">Na fase da instru\u00e7\u00e3o processual, o Minist\u00e9rio P\u00fablico de Contas do Paran\u00e1 (MPC-PR) destacou o fato de que o Munic\u00edpio realizava a contumaz terceiriza\u00e7\u00e3o de servi\u00e7os jur\u00eddicos, situa\u00e7\u00e3o que se configurava consolidada antes mesmo da apresenta\u00e7\u00e3o da consulta. Fundamentou que a resposta da Corte de Contas n\u00e3o poderia, de forma alguma, legitimar a contrata\u00e7\u00e3o indiscriminada de servi\u00e7os jur\u00eddicos.<\/span><span requereu a instaura\u00e7\u00e3o de Tomada de Contas Extraordin\u00e1ria para investigar a irregular terceiriza\u00e7\u00e3o dos servi\u00e7os jur\u00eddicos rotineiros no Munic\u00edpio de Jaboti, a qual foi acolhida pelo Conselheiro Maur\u00edcio Requi\u00e3o de Mello e Silva, conforme <a href=\"https:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2025\/09\/JABOTI-DPD-1235_25-GCMRMS.pdf\">Despacho contrata\u00e7\u00e3o de escrit\u00f3rios de advocacia, os quais foram redigidos da seguinte forma:<\/span><span Procuradoria Jur\u00eddica; a maior habitualidade e experi\u00eancia para dilig\u00eancias in loco dos escrit\u00f3rios de advocacia com sede ou filial na capital ou nas cidades em que se encontram as sedes dos Tribunais, inclusive superiores; \u00e9 poss\u00edvel a contrata\u00e7\u00e3o direta de advogado ou escrit\u00f3rio de advocacia especializado e com maior experi\u00eancia no atendimento aos Tribunais, via inexigibilidade, para atendimento visando suprir tais dilig\u00eancias?<\/span><\/i><span de analisar todas as quest\u00f5es jur\u00eddicas, o que levanta a necessidade de contratar um escrit\u00f3rio de advocacia especializado.\u00a0 Afirmou, ainda, que a contrata\u00e7\u00e3o seria uma possibilidade de obter servi\u00e7os mais eficazes e, ao mesmo tempo, promover economia para a Administra\u00e7\u00e3o P\u00fablica, j\u00e1 que a realiza\u00e7\u00e3o de um concurso para advogado poderia acarretar custos e tempo elevados, al\u00e9m de impactar a folha de pagamento.<\/span><span data-contrast=\"auto\">Por meio do Despacho n\u00ba 856\/2023, o Relator admitiu a consulta e encaminhou \u00e0 Supervis\u00e3o de Jurisprud\u00eancia e Biblioteca (SJB) para juntada de informa\u00e7\u00e3o, a qual destacou a exist\u00eancia do Prejulgado n\u00ba 06, bem como o Ac\u00f3rd\u00e3o n\u00ba 449\/06, os quais possuem semelhan\u00e7a com o tema em an\u00e1lise.<\/span><span 14.133\/2021; da Lei Org\u00e2nica \u2013 artigo 11, incisos XXVII e XXVIII, 95, inciso II, 98, 100, 110, 112; e do Estatuto da OAB (Lei Federal 8.906\/1994).<\/span><span todas as contrata\u00e7\u00f5es de servi\u00e7os advocat\u00edcios em curso, n\u00e3o s\u00f3 a do credenciamento objeto do Edital n\u00ba 01\/2024, e da dispensa\/inexigibilidade do Edital n\u00ba 05\/2024, mas tamb\u00e9m de todos os v\u00ednculos que conferem a advogados alheios ao quadro de servidores o direito de representar o munic\u00edpio em a\u00e7\u00f5es que estejam ainda em tramita\u00e7\u00e3o perante o Poder Judici\u00e1rio. <\/span><span um quadro de pessoal, em especial no que tange a estrutura\u00e7\u00e3o dos servi\u00e7os jur\u00eddicos, seja por meio de Procuradoria Municipal ou outro arranjo organizacional, al\u00e9m do cumprimento da legisla\u00e7\u00e3o estatut\u00e1ria municipal referente \u00e0 carga hor\u00e1ria.<\/span><span Mello Requi\u00e3o e Silva reexaminou os fatos ap\u00f3s manifesta\u00e7\u00e3o da CGM e do MPC-PR, e verificou que a consulta, em que pese formulada por autoridade leg\u00edtima e acompanhada de parecer jur\u00eddico, n\u00e3o atende ao requisito previsto no art. 38, V, da Lei Complementar n. 113\/2005, e do art. 311, V, do Regimento Interno.\u00a0<\/span><span Nesse sentido, conforme precedente desta Corte, essas contrata\u00e7\u00f5es devem ser excepcionais, bem justificadas e n\u00e3o podem substituir os advogados p\u00fablicos efetivos. Logo, <\/span><span data-contrast=\"auto\">n\u00e3o se trata de um questionamento em tese<\/span><span data-contrast=\"auto\">, <\/span><span data-contrast=\"auto\">mas de caso concreto<\/span><span data-contrast=\"auto\">, do qual n\u00e3o est\u00e1 apta essa Corte de Contas a se manifestar, entendimento esse, inclusive, sumulado:\u00a0<\/span><span jur\u00eddicos, realizadas pelo Munic\u00edpio, foram realizadas em conformidade com as exig\u00eancias legais, quais sejam:\u00a0<\/span><span
