{"id":4246,"date":"2016-06-23T18:10:49","date_gmt":"2016-06-23T18:10:49","guid":{"rendered":"http:\/\/www.mpc.pr.gov.br\/?p=4246"},"modified":"2016-06-23T18:10:49","modified_gmt":"2016-06-23T18:10:49","slug":"stf-dano-ao-erario-decorrente-de-infracao-ao-direito-publico-e-imprescritivel","status":"publish","type":"post","link":"https:\/\/www.mpc.pr.gov.br\/index.php\/stf-dano-ao-erario-decorrente-de-infracao-ao-direito-publico-e-imprescritivel\/","title":{"rendered":"STF: dano ao er\u00e1rio decorrente de infra\u00e7\u00e3o ao direito p\u00fablico \u00e9 imprescrit\u00edvel"},"content":{"rendered":"<p style=\"text-align: justify;\">O Supremo Tribunal Federal (STF) esclareceu, nesta \u00faltima semana, que a repara\u00e7\u00e3o de DANOS AO ER\u00c1RIO \u00c9 IMPRESCRIT\u00cdVEL quando decorrentes \u201c<i>de infra\u00e7\u00f5es ao direito p\u00fablico, como os de natureza penal, os decorrentes de atos de improbidade e assim por diante.<\/i>\u201d<\/p>\n<p style=\"text-align: justify;\">A mat\u00e9ria foi abordada em Embargos de Declara\u00e7\u00e3o opostos no RE 669069\/MG (rel. Min. Teori Zavascki, 16.6.2016) que, em que pese rejeitados pela Corte, ressaltou o entendimento j\u00e1 exposto pelo STF no curso das discuss\u00f5es da decis\u00e3o embargada, que apontava para a necessidade de um prazo prescricional para a repara\u00e7\u00e3o ocasionada por <i>acidente de tr\u00e2nsito<\/i> (entendido como \u201c<i>il\u00edcito civil<\/i>\u201d, restritivamente, e cuja conceitua\u00e7\u00e3o, deste modo, obt\u00e9m-se por um m\u00e9todo de exclus\u00e3o).<\/p>\n<p style=\"text-align: justify;\">O precedente, entretanto, bem sinaliza as preocupa\u00e7\u00f5es do Tribunal quanto\u00a0\u00e0 correta\u00a0interpreta\u00e7\u00e3o do art. 37, \u00a75.\u00ba da Constitui\u00e7\u00e3o Federal (\u201c<i>A lei estabelecer\u00e1 os prazos de prescri\u00e7\u00e3o para il\u00edcitos praticados por qualquer agente, servidor ou n\u00e3o, que causem preju\u00edzos ao er\u00e1rio, ressalvadas as respectivas a\u00e7\u00f5es de ressarcimento<\/i>\u201d).<\/p>\n<p style=\"text-align: justify;\">Neste sentido, por sua import\u00e2ncia, o tema recebeu o recente reconhecimento de <em>repercuss\u00e3o geral<\/em> por parte do Supremo Tribunal Federal no Recurso Extraordin\u00e1rio n.\u00ba 852475 (Relator Ministro Teori Zavascki, Plen\u00e1rio Virtual, 20.05.2016), bem como no RE 636886 (que trata, especificamente, da <i>prescri\u00e7\u00e3o de a\u00e7\u00e3o de ressarcimento com base em decis\u00e3o de Tribunal de Contas<\/i>), com a determina\u00e7\u00e3o de sobrestamento de processos judiciais que discutam essa mat\u00e9ria nas demais inst\u00e2ncias.<\/p>\n<p style=\"text-align: justify;\">A expectativa do Minist\u00e9rio P\u00fablico de Contas, no t\u00f3pico, \u00e9 que se confirme a\u00a0hermen\u00eautica restritiva de &#8220;il\u00edcito civil&#8221;\u00a0lan\u00e7ada no RE 669069\/MG, pois as determina\u00e7\u00f5es de restitui\u00e7\u00e3o e responsabiliza\u00e7\u00f5es\u00a0originadas do Controle Externo s\u00e3o, em sua quase exclusividade, advindas de \u201c<i>infra\u00e7\u00f5es ao direito p\u00fablico<\/i>\u201d, sem o que ficariam, num outro entendimento, praticamente sem consequ\u00eancias as apura\u00e7\u00f5es realizadas pelos Tribunais de Contas se alcan\u00e7adas por prescri\u00e7\u00e3o, consoante as compet\u00eancias listadas pelo art. 71 da Constitui\u00e7\u00e3o.<\/p>\n<p style=\"text-align: justify;\">A imprescritibilidade de danos ao er\u00e1rio decorrentes de infra\u00e7\u00f5es ao direito p\u00fablico apuradas no \u00e2mbito do TCEs, conforme art. 37, \u00a75.\u00ba da Carta Maior, \u00e9, portanto, imprescind\u00edvel para o efetivo e eficaz\u00a0<b>combate \u00e0 corrup\u00e7\u00e3o<\/b> e \u00e0 <b>m\u00e1 gest\u00e3o<\/b>.<\/p>\n<p style=\"text-align: justify;\"><img decoding=\"async\" class=\"aligncenter  wp-image-4247\" style=\"width: 520px; height: 256px;\" alt=\"STF\" src=\"http:\/\/www.mpc.pr.gov.br\/wp-content\/uploads\/2016\/06\/STF-300x129.jpg\" width=\"300\" height=\"129\" \/><\/p>\n","protected":false},"excerpt":{"rendered":"<p>O Supremo Tribunal Federal (STF) esclareceu, nesta \u00faltima semana, que a repara\u00e7\u00e3o de DANOS AO ER\u00c1RIO \u00c9 IMPRESCRIT\u00cdVEL quando decorrentes \u201cde infra\u00e7\u00f5es ao direito p\u00fablico, como os de natureza penal, os decorrentes de atos de improbidade e assim por diante.\u201d A mat\u00e9ria foi abordada em Embargos de Declara\u00e7\u00e3o opostos no RE 669069\/MG (rel.
